HYCON S.r.l. processes all orders based on the following terms and conditions of sale. Conditions proposed by the customer or conditions other than those indicated in our terms of sale will not be accepted.
Purchase modalities
HYCON s.r.l. is not responsible for the data compiled by the customer at the time of ordering. The customer must verify the correctness of all parts before placing the order. By confirming and sending the order electronically, the purchaser makes an irrevocable proposal to purchase the products selected in the shopping cart and is obliged to pay the relative amount.
L’ordine potrà considerarsi valido solamente dopo aver effettuato il pagamento. The sale will be completed only upon receipt of payment by HYCON s.r.l. which will issue an acceptance of the order by sending an e-mail confirming receipt of the order. HYCON s.r.l. will communicate the order confirmation by sending an e-mail to the e-mail address supplied by the customer. This confirmation message will propose all the data entered by the customer who agrees to verify the correctness and communicate any corrections.
An order on the site www.hycon.bike the customer declares to have read the terms of sale, the proposed payment methods, and the entire purchase procedure.
Products available in stock will be prepared upon receipt of the order and shipped according to the schedule. In the case of products that are not immediately available, a pre-order can still be placed according to standard purchasing procedures. Products will then be shipped according to their availability based on production times and the supply of materials and components.
HYCON s.r.l. reserves the freedom to make changes in design, materials, and components. The images of the products on the site www.hycon.bike and on social media are purely indicative. Moreover, the colors may vary in tone depending on the device from which the photo is displayed.
Our prices include VAT and do not include shipping costs. All local taxes and customs duties are the responsibility of the customer. HYCON s.r.l. reserves the right to make changes to prices without prior notice.
Payments
The prices published on the website www.hycon.bike are in force at the time the order is sent by the buyer. Any shipping costs, customs duties, taxes and other fees or surcharges will be borne by the buyer. The payment of the purchased products can be made exclusively through the following methods of payment:

The goods ordered will be shipped only if the purchase price, including any services and/or additional charges can be charged to the payment method indicated by the customer and HYCON s.r.l. will have seen the payment made by the purchaser. If the charge is not successful HYCON s.r.l. has the right to suspend or cancel, at its discretion and at any time, the execution of an order and / or shipment of products ordered.
Delivery, Warranty, Withdrawal and returns
Delivery
The products ordered by the purchaser – according to these conditions of sale – will be delivered to the address provided by the purchaser. In the case of incorrect, incomplete, or unclear information on the address provided, the customer will be notified by e-mail to correct the data. HYCON s.r.l. is not responsible for non-delivery or delays due to incorrect shipping addresses, communications sent to incorrect e-mail addresses, or in case of failure of the e-mails.
At the time when HYCON s.r.l. entrusts the shipment to the courier, the customer is notified by an e-mail confirmation shipment. This e-mail contains all the details in relation to the delivery: list of products shipped, amount due, tracking number of the shipment with a link to the courier site (if available). From this moment onwards, the delivery times will start according to the type of delivery.
HYCON s.r.l. is not responsible for delays in delivery due to unforeseeable circumstances or circumstances beyond the control of the party, such as all cases of force majeure and similar events as well as delays in delivery by suppliers for any reason.
We recommend you to carefully check the box before signing. Damaged boxes should not be accepted. Boxes with visible dents or scratches must be accepted with reservation or not accepted at all. In case of damaged boxes, we advise you to send us an e-mail to info@hycon.bike within 24 hours.
Shipping costs are always borne by the buyer.
Shipping costs are always displayed in the checkout phase of the order and are charged to the buyer. For shipments outside the EU, the customer must ensure to have all permits, licenses, approvals, registrations, certifications, and any other documents necessary to import the goods.
Any costs incurred in obtaining such documents shall be borne by the customer. Any duty that is payable on an item will be required by the courier on behalf of your local customs office and you will have 21 days to pay this balance. If for any reason the package is returned to us any outstanding customs fees will be deducted from any refund.
Warranty
The consumer can benefit from the legal guarantee of conformity for all items purchased on our website www.hycon.bike. HYCON s.r.l. is liable to the consumer for any lack of conformity that becomes apparent within 2 years from delivery of the product and that is reported by the consumer within 2 months from the date of discovery of the defect. The Buyer must report any lack of conformity by email to support@hycon.bike by sending a description of the defect, explanatory photos, the date on which the defect occurred and indicating the date of purchase supported by the documentation (invoice)
If a warranty claim is made in due time, HYCON s.r.l. shall remedy the defect, at no expense to the purchaser, by restoring the conformity of the product by repairing or replacing it. If HYCON s.r.l. is unable to repair or replace the product, it reserves the right to offer a similar replacement of equal or greater value or a partial refund proportional to the remaining life of the product.
Warranty is non-transferrable and applies to the original purchaser only. The warranty does not cover defects or damage caused directly or indirectly by improper use, poor maintenance, violence or manipulation, storage not in accordance with the relevant instructions provided.
Moreover, it is assumed that the instructions provided are followed. HYCON s.r.l. reserves the right to examine the allegedly defective products to verify the actual existence of the defects reported by the consumer in the manner it deems necessary. Le spese di spedizione del reso saranno a carico del consumatore. Eventuali danni subiti dal prodotto in fase di spedizione del reso saranno responsabilità del consumatore e non saranno coperti dalla garanzia. In no case will unauthorized returns be accepted. La presente garanzia non pregiudica i diritti legali del consumatore. HYCON S.r.l. si riserva il diritto di rifiutare qualsiasi richiesta di garanzia.
HYCON s.r.l. guarantees the conformity of the products to the declared technical characteristics and their immunity from defects, as well as their safety according to the standards in force at the time of their placing on the market.
The acceptance of the products by the shipper, the carrier or anyone else in charge of the collection is in accordance with the good condition of the packaging and any liability of HYCON S.r.l in this regard ceases upon delivery.
The Buyer is also required to check upon arrival that the products are in conformity with the order and to verify the goods immediately after delivery and in any case before it is in any way used or otherwise altered. In default are considered compliant and accepted.
A product that has defects that make it unsuitable for the use to which it is destined or that appreciably diminish its value or when it does not possess the essential qualities for the use to which it is destined.
In the event of justified and timely complaints, accompanied by the information requested and provided that the defects are not linked to transport, misuse and/or storage, incorrect assembly, or inappropriate use, in any case the responsibility in general, is of the Buyer, its successors or third parties. The Buyer, at no cost to him, is entitled to the restoration of conformity of the purchased goods, by repair or replacement by the Supplier.
If this is not possible, the Buyer shall be entitled to a reduction in the purchase price or, if the defect is not only minor, the termination of the contract, in all cases upon return of the original Product by the Buyer. The repair and delivery costs of the repaired or replacement Product are borne by HYCON S.r.l, The return of the original Product is the responsibility of the Buyer and will be refunded only if the dispute is well founded and after delivery to HYCON s.r.l. of the proof of payment.
Compensation for damage shall in any event be excluded, except in the case of willful misconduct or gross negligence.
HYCON s.r.l. disclaims all liability for any damage to property and/or persons resulting from the improper use of the product, by the buyer or third parties.
Defects resulting from normal wear and tear, misuse or accident caused by an external element or through a modification neither foreseen nor authorized by HYCON s.r.l., are excluded from this warranty.
The warranty does not operate if the product is combined with components not marketed by HYCON s.r.l. or the warnings and prescriptions provided or expected according to a normal standard of care have not been observed.
The warranty does not cover parts subject to normal wear and tear, faults or malfunctions and damage caused by improper use or improper maintenance of the products as provided in the owner’s manual. The warranty does not cover even if the product is damaged or in any non-compliant behavior or omission attributable to the buyer or his successor.
HYCON s.r.l. will in no case be liable for damages caused by defective or non-compliant products and this in express derogation from art. 1494 c.c.
Withdrawal and returns
The right of withdrawal can only be exercised by natural persons.
You have the right to withdraw from the distance contract the “consumer” referred to in art. 3 of the Consumer Code, that is, the natural person who buys products for purposes not related to his professional activity. The right of withdrawal does not apply, therefore, in the case of purchases made by companies and professionals, invoiced with VAT.
The consumer has the right, recognized by Legislative Decree 206/05, to exercise the right of withdrawal from the Purchase Contract, for any reason, without explanations and without any penalty, with the following procedures specified within 14 working days of receipt of the goods purchased and provided that the product has not been used.
The communication must be sent by email to support@hycon.bike within the above deadline. Such communication must clearly indicate the will to withdraw from the purchase of the products that must be identified with precision, and to it must be attached a copy of the invoice.
The return of the goods must take place within 14 days from the date on which the Customer has communicated his decision to withdraw. This deadline is considered respected if the Customer ship or returns the products before the expiration of 14 days. The Customer may return the products by delivering them to the address provided by HYCON s.r.l.
All payments made except for transport and insurance costs will be refunded to the Customer within 14 days of knowledge of the notice of withdrawal. The transport costs related to the return of the products subject to withdrawal are borne by the Customer and the return is under his complete responsibility.
HYCON s.r.l. reserves the right to withhold the refund until the arrival of the marches and the complete check of its integrity.
Upon receipt of the goods and after verification of their integrity, HYCON S.r.l will refund the amount received for the sole purchase of the products and not the transport costs of the return that are fully borne by the Customer, reserving any compensation for damages found on the products. If the returned product is defective, even minor, found at the time of return, HYCON s.r.l. reserves the right to reduce the value of the refund to compensate for the damage found on the product.
The refund of the sums collected by HYCON s.r.l. for the purchase of the products will be made by bank transfer with current currency to the current account provided by the Customer.
We recommend that you insure the return shipment. HYCON s.r.l., in fact, is not in any way responsible for theft, loss or damage of returns shipments.
Shipments will not be accepted at the expense of HYCON s.r.l. In this case, the package will be rejected to the sender and the shipments (return) will be fully charged to the Buyer.
Before returning the goods, the Customer must ensure that the returned products are intact and in normal condition. The handling and packaging necessary for the shipment will all be borne by the Buyer.
In case of damage during the return transport, the withdrawal request will be cancelled and HYCON s.r.l. will send notice to allow the Buyer to make a claim against the courier and ask for a refund. If the right of withdrawal is exercised beyond the period provided for by art. 64 D. Lgs. n. 296/2005 the HYCON S.r.l will reject the good to the Customer by charging him again the costs of transport and delivery.
These conditions of sale will be an integral part of the purchase contract. These conditions of sale are published on the website www.hycon.bike and are approved and accepted with the purchase made through the shop of the site or made through crowdfunding portals (kickstarter, Indiegogo, etc.)
Rules Applicable
For anything not expressly provided for or governed by this Agreement, please refer to the provisions on the sale of consumer goods, referred to in D.Lgs. n. 206/2005, as well as the rules of the Civil Code.
